Visa Processing under exemption-- PLEASE HELP...!!!

Hi,

I had a valid H1B visa till August 2006, but got expired as I returned to India and it was not sent for renewal. The first 2.5 yrs got over and it should have been sent for renewal but renewal can be done only in US and I returned to India in Feb 2006.

However, I heard that fresh H1B visa can be filed under exemption before one year after return to India i.e, after expiry of visa and before Feb 2007.

Is this true? can someone give me details about this if this can be done?

Your sponser still apply for new H1 for you while you are in India any time in US which will not come under quota.
