visa number questions

Talked to IIO and was told that they stoped sending FP for Chinese/India cases because no visa number avaliable for them. What does that mean? I checked the visa avalibilty announcement phone (202-663-1541) and it says visa for EB1 Chinese/India are current. Any idea?

Assume what you heard from the IIO is true, the reason that you
have not received FP notice (I assume) is probably that
(1) they think that for Chinese/Indian with ND like yours
    (10/99 or later), the PD is probably not current, since
    those PD-current-now would have already summitted their
    485s before 10/99.

While EB1 is all current, but
(2) the 485 receipt notice does not print the prority date,
    and the lazy clerks don\'t want to look up the underlying
    I-140 to find out your PD. So, they just assume yours is
    not current if your ND is 10/99...

I agree with you infosrc. I called IIO this morning and she was nice enough to go through the papers.She told me that my case has taken longer than expected and she would initiate the finger printing process for me. She also mentioned that it will still take 1-2 months before I get the notice.
One additional piece of info, she said it will take anywhere from 6months to 12 months before I see the approval as there are many cases pending.

Interesting remark, any clue how will they handle my scenario.
My scenario is interesting, I am born in India, however my
wife is born in another country other than India/China,
I have filed on the basis of cross-chargeability on spouse\'s
country of birth. My PD is not current. Do u think my file
will catch dirt on the shelves too any comments.

Hi,

I just got off the phone (3.30) with an IIO. I\'m EB1 too. She said EB1 India would not be affected. What they are doing is scanning through all the applications and when they find EB1 cases they are mailing out FP notices. According to her thats why we see FP notices being issued to other countries, which probably have less 485 cases, with later dates than EB1 India cases.

Well, as usual take what the IIO\'s say with a pinch of salt. :)

what about eb2 cases which are current or have been for a long time?

Also, does anyone know the folx at immigration-law.com? They usually have good information on what\'s happenning at the service centers. Anyone tried to talk to them to find what\'s happenning at VSC and when they expect to start issuing FP again?

EB1 should not be affected for both Chinese/India cases. However, they may not sort the files based on categroy, therefore, just treat all as \'no-current\'. EB2 may be affected because the visa number is not avaliable. I am still waiting for FP (EB1, nd=10/7/99) hopefully, somebody may dig it out.
