Visa Number not Available

Hi ,

I saw on isn.org that someone got a response saying that "Visa number not available". Does this mean that we will not see any more I-485 approvals for this year for India?

Did anyone on this board receive such a letter?

Yesterday when i called IIO she said something on the terms of visa numbers getting over fast, and said it will be over soon. She also said that if visa numbers are not available and if one\'s PD is not current then they would not be issuing FP notices for them.

All of these issues, makes the whole process very confusing and chaotic.

I am not sure. No one knows what their process is.

1. It could be that it could get over only for few countries, in which case other visas for other countries will still be processed.

2. It could be that they presume that visas got over after taking into consideration the applications that are checked out by officers for review,RFE\'s etc. in which case we should be still seeing approvals.

3. Lastly, there could be "n" other reasons.

After taking into account all these factors we still have to consider the major factor of "Reliability on IIO\'s", although the lady i spoke to yesterday was very nice, patient and tried to explain the process at detail (in spite of which i still feel the process is very confusing).

What is the situation if PD is current? (or is this an oxymoron? I mean visa numbers being unavailable and PD being current)

Would they still process the AOS application?

I think that the new visa numbers will be available on October 1st. If the visa numbers for next year get over as well, then it is one more year wait... :-(

This process is sickening!! I keep checking the site

It should be Oct. 2000.

If the visa numbers are not available for the country then the AOS applications will not be processed even if the PD is current.

Let\'s assume P.D is current now :
The moment they try to process the AOS, they will request for Visa numbers, if you are lucky and your request goes along with fewer requests for P.Ds older than yours , due to slow and out of turn processing of 485s, you may get approval . I think that is very , very unlikely.

If there are enough requests to exhaust the monthly allocation of the yearly quota ( refer July or August 2000 Visa bulletin at travel.state.gov) for your country , then P.D won\'t be current anyway.

Monthly allocation now should be substantial , since they did not process any 485\'s for the first 6 months of the fiscal year starting OCT-1999 thru Mar 2000. So more visas must be available in the current months.

We are just 7 weeks away from the new FY (Oct 2000). As of now visas are still available. So let us hope that the quota will be sufficient enough to last for these 7 weeks.

At what point of time in 485 process the VISA# are assigned to a case?
Is it just before the approval or when they start processing the case?

I am concluding from your message that you got an RFE, is this true. I am worried too. I will be responding to an RFE in the next couple of days. If they say quota is over before they get to my application that will really suck. I have seen so many people with PDs and RD/ND much later than me get approvals without getting RFEs. I almost feel like screaming that these people are stealing visa numbers that actually belong to me.

Hey guys!!
some one just posted the rumor about the visa unavailble letter without actually confirming the facts. So dont worry. The person who posted it actually read about the visa unavailable letter from a very old post( which could have been a last years post).

So hang in there and pretty soon all of us will have our approvals..Again I think its just a rumor at this point. FP\'s are sent out irrespective of PD being current and visa numbers being unavailable if the I 485 is filed so the IIO was just BS.

Till one of us actually gets the letter and sees it with their own eyes and posts the info here, don\'t believe it and ruin a good nite\'s sleep...

PD of March 1996 and before and still have not gotten their approvals.

Well my PD is 10/97 and I am EB2. In my opinion I am equally injured as the EB3 guys with PD 3/96. Think about it this way - the years EB3 guys spent in LC hell we EB2 NIWers spent doing hard labor in graduate school getting our Ph.D.s. In my mind the two are totally equivalent.

Hi VSC/485,You may be a Ph.D. But Please stop envying others. I know your mental agony.Your day will come soon. I had to wait for atleast 4 years and 8 months to get my 485 approved and stamping done quite recently.This is just for your info.

Please stop saying "your day will come". This statement drives me up the wall whenever I hear it. If you don\'t want to offer constructive suggestions as to how one may hasten the process, I suggest you don\'t say anything at all. "Your day will come" or "your turn will come" are some of the most irritating assurances I have read on this board. Please don\'t mistake me, I am not picking on you in particular. I notice several people saying such things. It doesn\'t help at all.

I apologize for sounding so rude in my last message. I am usually not someone who blows off on people on the internet. This GC process has made me lose all perspective. I just went back and read my message and saw how rude I sounded. I sincerely apologize. Wish you all the best and wish all of us all the very best in getting our GCs.
