If you go to America on a tourist visa, can you apply for a family based immigration visa while on the tourist visa??

If so, what do you need to do?

No need to go to USA

To apply for a family based Immigration visa you no need to go to USA. If you apply while you are in USA, next time you will not get your tourist visa. The reason is tourist visa is non-immigrant intent, if they know you are pending immigrant, (you can not hide this fact in your applications), your non immigrant visas B or F will not be issued.Thanks

Which category are you going to apply for family based immigration?

Still you want to apply, Apply I 130 petition.
 
Ok listen .....

I have kids in America and I want to go see them. Me and my husband thought it would be best if maybe we went to america to live so I could be closer to my kids. I have not seen them in almost 2 years and can't wait any longer...

If we were to go over for a visit (my husband on the visa waiver program), stay for 90 days (file the I-130 whilst in America), my husband return to England after 90 days to have his interview and wait for his immigration visa but I stay in America and set up home, would this be ok to do??

I was told since I am a US citizen that I could file the petition for my husband who is British. My kids are only 13, 12, 11 and yes they are US citizens.

I have lived in the UK for alittle over 2 years and have an indefinite leave to remain but still I am US citizen.

Same issue

I did find out that I can do the DCF in London because I have a leave to remain. What I don't know is how long this takes to be completed before we can actually move to the states...

And also can we travel for holiday while it is being processed??
