My son is 4 yrs old and is US citizen. I am currently on H4 visa and residing in US along woth my son. I am in process of receiving my divorce.I would like to know if I can apply for any visa here that can help me work and reside in US to support my son and myself.

My husband is in the process of getting his Greencard. he has initially added my into the Labour process.Now he is legally bound to add me into the next process of I40 and I485. He applied in Oct 2006 (EB2).. I would also like to know how and where can I have knowledge of my Greencard process and how to proceed further.

This will be of great help if some one can reply me.

Was your I-485 filed? Or was it just his alone? Or is it that you don't know?
 
Having a USC child grants you no benefit until he is 21 so that is not an option. You may certainly find your own H1B employer if you are qualified and perhaps they will petition for your GC in the future.

Once you divorce you are no longer eligible for H4. Your soon to be ex does not have to do anything for your GC; in fact, if you are no longer a dependent, you do not qualify for a dependent GC if you do not already have it. I hope you have considered the problems of your child during the divorce procedure. International child custody is a big problem.

You really need to be addressing these issues with your divorce attorney.
