I have some problem in my case.
I arrived in United States in november 26 2009, I got 6 months in my I-94.
In january 17 2010 I had a big car accident that's make me needed some surgery and treatment, then I applied to extension visa in 18 may 2010 and my I-94 only expire in may 27 2010, I applied before my I-94 expire.
After 5 months, the process still in initial review, I decided to stay in United States and I went to school to fill the application for student visa F1 before receive answer about my extension, because has spent 5 months and nothing.
I have canceled my extension application and I filled a new I-539 for student visa F1, they accepted with no problem.
After 2 months I received request for evidence and I have not send back to USCIS in time and my application was denied considered abandoned in 31 March 2011.
I sent my I-94 original to USCIS in my first application and they never gave me back.

So, If I stay in United States which is my status for now ?

What difference between I-539 denied and stay with I-94 expired ?

What happen if I back to Brazil in next days ?

thanks

What is the difference between my status or who enters and stays with the I-94 expired ?

I'm just I-94 expired, or my case is more complicated ?

Some peoples say when you are overstay you are just I-94 expired, but when you try an extension or change your status and it's declined, you are on order to deportation. Some one confirm that or is bullshit ?

You do not have a valid I-94 nor do you have a pending I-539. You are accruing an overstay now.

I agree to this, you should seek for professional helps in your case. There are many ways professionals that can help you in that matter and not only US cases they are capable of when it comes to visa, there are also some who can process not only I-539 but also 457 visa. Just abide the law and you won't have worries at all. :)
