Visa Extension For PR - Very Critical - Help Needed

I'm pretty new to this forum... I have a problem.... I have got the candian permanent residence and got stamping in my passport. The visa was issued on the last week of september 2003 and it is valid only till jan 3rd 2004.

I was in H1 B for so long and so didnt have advance parole... suddenly due to circumstances, i had to change to EAD, so now if i apply for advance parole it will take a minimum of 45 days & maximum of N number of days ! May be i will get it some time past january last week !

The visa issued for canada says that it is the maximum period issued and cannot be extended. If you cannot make it before visa expiry, you got to re-apply for the whole damn immigration process!

This is so weird as the process takes 3 yrs and they give us 3 months and not even a second chance that might be needed due to emergencies !

Please let me know what can i do to solve this problem.

You will have to come up with some compelling reasons to get expedited service for AP. Reasons like close relatives are very sick or something like that and you need to immediately go back home. In such circumstances you might get expedited service. I am pretty sure you won't get expedited service because you need to go to Canada to complete immigration and then come back. I think, for expedited AP service you should consult with your lawyer.
 
I got my passport stamped with Canadian PR yesterday at New York. My Canadian Immigration visa expires on 6/26/04. My I-485 receipt date is 4/25/02. The process is so slow and unpredictible, I am not sure when will my I-485 get approved. Therefore, I am planning to apply for my Advance Parole now so that I can go to Canada before 6/26 and come back. I would appreciate if someone could tell me if it is too early to apply for AP or I should go ahead and do that.

----------- You changed to EAD, it mean you has EAD why did not you apply for AP when you applied for EAD or when sent I-485?
so now if i apply for advance parole it will take a minimum of 45 days & maximum of N number of days ! May be i will get it some time past january last week !

---- You knew it, the mistake you did is why you did not apply for AP when I-485 filed or later, you were knowing that anything can happen to job so one keeps valid EAD and AP.
Please let me know what can i do to solve this problem.


*** As per your info you used EAD, let me know if you still have Valid H1b visa stamped in passport beyond Jan 3, 2004?
** or do you have H1 extension approval and Visa expired
Or H1 approval extension validity

You can also visit local BCIS to get emergency AP they will ask for the proof if some body is sick, get a fax from your home country that XYZ is very sick and you need to come immediately, the letter should be from doctor or hospital on letter head with signature and stamp. If the local BCIS approves your AP then it does not matter if you visit Canada or home country, just show the AP at POE and you can enter
