Well. It would not hurt to have separate thread here in the NIW, EA forum. Some NIW applicants will comment on this, I am sure. The thread you have mentioned is probably good for EB3 people. Thanks.
 
I'm just glad to see that EB1 is current again. Some forum members had predicted very strongly that it would be backlogged.

The reason I'm posting here is that the EB2 and EB3 people will not be happy with this VB at all due to obvious reason and I don't want to hurt their feelings. this forum is specifically for Eb1 and NIW and easy to keep track.

This is a surprise because last month American Immigration Lawyers association predicted that EB1 will be backlogged till Jan 2007 for India and China. They had spoken with the person who heads this visa bulletin department. Due to the rush of I485 filings in July there will obviously some backlogs and slow processing for everyone. However it seems DOS has put all the heat on poor EB3 and EB2 folks. Interestingly, In the month of June, July and August, they had given away most unused EB1 visas to EB2 and EB3 to clear backlogs. Thus the September Visa bulletin for EB1 shows dates pushed back and there have been very few EB1 approvals during July, August and September.

eb1a-query, Why are you stuck still. Did you check your name check status? Few March/April 2007 I485 filers have got approvals this month or earlier.

Well, there are people before me who haven't got their I-485 approved yet. In fact I have not seen any approvals for March/April 2007 filers for EB1. I'm talking about people from China and India only. last person I saw was chatterjee with PD in late 2006.
 
Hi eb-1query,

One more member in this forum (mogambo) whose PD is 2005 still did not get the approval. He got two I-140's approved under EB-2 NIW (in 2005) and EB-1EA (in 2006) if I am correct. Do not know the reason why his case is delayed.

Yeah, that's what I wanted to say that from the retro countries I haven't seen any approvals filed this year. there are some folks waiting from 2005 and 2006 as well.

Hi,

Did you get an RFE on your I-485? what was it about? also which country are you from?
 
Its was was Birth Certificates and my work status, as I was on H1 then F2 and then H1B, but had filed it while on F2.
I am from India and case is at Nebraska

Thank you, sjsd. I think, this is all good. They are definitely looking at your case and it is in accordance with the NSC processing time.
You should get approval soon.

Eb1-eb2

I would say EB2 will be still backlogged for a good 1 year. There may be instances that it may become current before next october.

There was an LUD 09/12/07, after the rfe was received,09/11/07 so I am a bit nervous. Will post the updates
