Bad news for EB-3 which is Unavailable!!

The Employment Third and Third Other Worker categories have reached their annual limits and no further FY-2005 allocations are possible for the period July through September. With the start of the new fiscal year in October, numbers will once again become available in these categories. It is not possible to make any estimates regarding potential cut-off dates at this time

Does that mean that starting Oct1 2005 you can file your 485 in WorldWide category or there will a retrogression date like China and India?

Not exactly. We can say that they will have visas available to allocate for EB-3 guys as new Fiscal year starts from Oct '05 (till Sep '06) . So atleast EB-3 will NOT Unavailable from Oct '05. But still there is no gurantee that it will be current. May be they will issue new cut-off date for EB-3 (and may be for other category, e.g. EB-2, as well if demand is high). We have to wait till mid of Sept '05 for Oct '05 visa bulletin which can answer your question more precisely.

Can I file till the end of the month?

Hi,

I could not interpret the bulletin in the sense that whether we could still file in next two weeks i.e before the end of the month of June? Or, is it applicable immediately?
