Darker side of USCIS

On one hand it gives great pleasure to see the dates are current. On the other hand there is a darker side to this. USCIS wants to collect as much money as possible for EAD and AP renewals. With the new fees that will take effect after July 30th, they want as many people in this GC trap. I am on my 5th EAD and AP, once in every 10 months (until last year), and once every year from this year onwards I set aside hard earned money to these lazy idiots !

Sorry for the rants, but this is the truth !!!

Another issue is that the service centers may get inundated with new Green Card applications starting July 1st and further delay our case processing. Oh well, there are always two sides of these things...

* July 2007 Visa Bulletin means that effective July 1, 2007, there will be a mountain of either concurrent or stand-alone I-485 filings. Without doubt, it will affect the processing times for the I-485 applications. Accordingly, those who have certified labor certification applications or who will receive the certification of labor certification should file the I-485 applications as early as possible in July 2007. Remember the following prediction of the DOS!!!
* EMPLOYMENT-BASED VISA AVAILABILITY DURING THE COMING MONTHS: All Employment Preference categories except for Third “Other Workers” have been made “Current” for July. This has been done in an effort to generate increased demand by Citizenship and Immigration Services (CIS) for adjustment of status cases, and to maximize number use under the annual numerical limit. However, all readers should be alert to the possibility that not all Employment preferences will remain Current for the remainder of the fiscal year. Should the rate of demand for numbers be very heavy in the coming months, it could become necessary to retrogress some cut-off dates for September, most likely for China-mainland born and India, but also possibly for Mexico and Philippines. Severe cut-off date retrogressions are likely to occur early in FY-2008.
 
Not Fair.... AT ALL no First In First Out

This is really Crazy....

People are waiting form 2001 for GC and these guys have open flood gates.. and I have been seeing approvals for 2003 / 2004 cases.. and no wonder they will approve next month cases also..

Where is the Justice?

Not sure.. how this kind of advanced country can do things like this very happazzard with out proper process and procedures.

Not sure what they are up to..

Probally they will get more papers on illegals now..

only thing they have to outsource this process to India / China.. to move things fast.

Dont know if we need to laugh or cry at these people procedure and process..

Hope things will go as First In First Out which is ethical and justification way to move things.

Hope some one from high level of USCIS looks at my message and take necessary actions and set right there process and procedures..

no other words to explain this Irony of Life..

Why do you want everyone to go through the pain you went through.

I am very happy for even this one month break. This will allow many people start working with lotter H-1B this year many H-4 who offered jobs on H-1B are helpless until 2008 Oct,
some will be able to change employers.

There are all kinds of immigrants in US. Some do not care GC and open to go back, for some EAD is essential to make life either for Spouse or for them selves, for some 10 years on H-1B is haunting and they do not want to visit home because haunting Consulate experience, when they go to see their loved ones back home they should go to Consulate for 5th or 6th time and you how haunting it is even for one time, they are looking for a break. This will certainly help everyone. I truly wish States to open the gates one month in each year to help those suffering, if they cannot change law and increase numbers, atleast they can certainly do this.

And people who are cribbing about AP and EAD fee raise, convert to what your employer is making because of your H-1B. Compare that money to your once a year fee and I am sure you will save 11 times more money of your EAD and AP fees every year. Or take a step a head if you are competent enough, ask your dream employer to sponser pay for your EAD fee.

So, stop cribbing, and be happy for yourself and others. For all practicle purposes EAD is as good as Green Card. May be u still need a visa to Canada and some other countries but thats a matter of $150-$500 for that don't crib on those who are just fighting for work life which in turn makes family life smoother.

Being a non-immigrant or to-be-immigrant or immigrant yourself, Learn to understand others problems and think genuine.

I understand where you are coming from. But you'll have to understand the spirit of what Green Always says: He is NOT against new candidates getting green card provided the older candidates get their green card first. What's wrong in his expectation? There are people waiting since 2001 and justice should be meted out to them first. If adjudication happens on a First-In-First-Out basis then nobody will carp. The process USCIS follows is unfair to many of our buddies. My PD is Feb 2003 but I honestly wish that 2001,2002 cases are adjudicated before mine if their case is clear. Let's understand each others' feelings and be united in this hour of crisis. Thanks
 
First of all, I'm really happy the gates were opened for Eb3. But it also means lots of new bottlenecks for those waiting for 485 approvals.

And the system is totally unfair, it's First In Random Out.

So, stop cribbing, and be happy for yourself and others. For all practicle purposes EAD is as good as Green Card.
That is not correct. Million reasons why it's not.
One example of the "practical purpose" of GC (somewhat exotic but anyway) : you cannot register an airplane for yourself unless you have a GC. :)

Maybe for you it is practically the same as a green card, but for others there are still meaningful differences:

1. Can't go into business full-time with your own company, without taking a big risk with the green card.

2. Can't make major career moves like changing from engineer to manager, because of the "same or similar job" limitation.

3. Re-entering the country with Advance Parole means you'll be sent to the back room for possible interrogation, where anything could happen.

4. Can't renew your driver's license on the spot (this depends on which state you live in). When you go for renewal, they take away the original license and give you a temporary driving permit which cannot be used as ID and is unlikely to be accepted by car rental companies (this is a problem for me because I sometimes travel to one of my company's offices far away and need to rent a car). Then only after some number of weeks when they verify your status you get the renewed license ... and it is only valid for one year then you'll have to repeat the same crap again.

5. And most importantly: If you lose your job and your employer revokes your I-140 before you can find another "same or similar" job, your I-485 is denied and you have to leave the country.

EAD is more like a portable H-1 than a green card. Your every move is still at the mercy of the government and your employer.

Old applicants are not complaining about new applicants. It is more of setting up priorities based on application dates....And more over, lot of people are applying on sold labor certificates. That's unfair.

This does not need a BIG explanation to justify.

If you are standing in a queue, and some one cuts the line infront of you, do you keep quite???? Won't he be asked to go to the back of the line. By the time the last guy comes to the serving window and the retro kicks in, it is not the fault of the guys in the front. Coz, they waited for 3 Damn years since Jan 2004 (the date when retro kicked in) patiently in line.

And I guess once in US most of us follow the queue system. Folks this is not India, please fall in line.
 
Well said veterens!!! All the new applicants, Don't antagonize the veterens...thay have shared wealth of information in this forum...you will stand to benefit from their experiences...--be it how to get an infopass, how to open an SR, how to clear your NC, how to file AC21, et al.

Let's share & understand our pain...work together to get over this GC muddle...just my 2 paise

I agree with anandkan and jackolantern and others. Jack had laid out some of the issues one faces being on EAD and there are other issues as well. I'm on my third EAD and for me, and I'm sure for many others, EAD is not the same as GC.

Now that all categories are current, it is only fair to process cases based on RDs,period. No cutting the lines baby!! Stand in line and wait for yr turn.

It should be based on PD and RD... (Period)
There are many ppl applied in 2000/01/02 and their labor was stuck up in Philly center and now they are getting approval. Do you think they should wait again and RD will have priority over PD.

Iam happy for new applicant but based on previous experience with USICS and this immi centers... they are so unorganized, old applicants are going to face challenge because of random approvals or burden of new applications.

Totally agree the process has to be FIFO based on PD.
Unfortunately it won't. Just recall the traffic lights. You go on green and then the next one is green and so on and so on until you encounter some stupid red light for the first time. You wait then it's green again so you drive another 1000ft within speed limits and voila it's a red light right in front of your nose. And all those guys who were speeding are disappearing in the haze over the horizon. And you sit here and wait for the green light.

p.s.
I have PD of 2003 and RD of 2005 and H1b extension valid for up to 11th year (It might be a sad record) as the first GC process that was started in early 1999 went belly up in 2002 along with the company. I'd gladly trade all that accumulated immigration-related knowledge for something more meaningful...
