I applied for my labor in April 01 in Ga and it took 2 years for labor to clear (State and Federal). This delay was caused by Labor apps filed in April 01. I followed the labor apps very closely at that time and found that the delay was due to 245i cases and once all those had been approved, non 245i apps like mine filed after April 01 started getting approved. If the 254i cases are only now getting approved as you say then why the hell was there a delay in labor apps 2 years ago. I was under the impression that most of the 245i labor apps were cleared by early 2004 atleast in the southern states going to TSC. Its hard to imagine that labor apps applied in April 01 are only now getting approved. Maybe labor substitution and all that. Its just ridiculous. What I am having trouble understanding is the fact that the flood of 245i labor apps that caused widespread labor delays 2-3 years ago are NOW causing delays in 485. What was going on with all these labor apps for the past 3 years. Its all to unclear.

If all your predictions come true then there is no point for people to wait around. Having an AP and EAD and waiting around for 3-4 years is not favorable for a lot of people. Who is willing to wait for 10 years for a GC. I don't think to many people are.

This process has reached ridiculous proportions. If things continue this way then people who have not yet applied will have to wait for 4-5 years to just apply for their 485s.

Now I fully understand this issue and have come to the sad realization that in the short term (next 2-4 years) most Indians and Chinese people with EB3s are pretty much screwed.

Let me ask you one last question. Say the current legislation to recapture 90,000 visas from previous years and not counting dependents goes through in December and becomes law (big IF) then do you think the dates for EB3s will move beyond April 01 and maybe into 02 or that is not going to have any effect on the EB3 dates for India. That is the only thing I am interested in at this point.

Personally I have decided to not wait beyond another year. Fortunately I have things to go back to in two different countries and both myself and my wife have educations and degrees from good colleges in the US along with 5+ years of experience. My wife is finishing up her Masters next year and if my application is still retrogressed at the end of 06 then I shall stop wasting my time and move onto newer pastures. Life plans and aspirations can be put on hold only to a certain point. A dream that each day looks further and further from reach will at some point turn into a nightmare. For me this dream has already turned into a nightmare and its time to wake up from it. If you check my signature you will see how I have been abused at every step by this process. The signature does not include a lot of nasty details that have completely ruined my faith in this so called "fair" system.

Anyway, thanks again for your insight. You seem to know more than most lawyers and are an exteremely helpful person. The USCIS could do with people like you.

My calculation.

Hi,

Let me try to use UN's method to do some calculation.

Say your big IF is true. We have 90,000 visa numbers recaptured and dependents waived from the visa number. According to UN's calculation, there are 150,000 245i EB3 applicants. For 2006, we have 140,000 + 90,000 = 230,000 visa numbers. EB3 has 28.6%, i.e., 65,780. Country limit is 7.1% for India, China, Philippean, and Mexico, so world others has 71.6%, which is 65,780 * 71.6% = 47,100. For following years, it'll be 28,670 since we don't have 90,000 unused visa any more. So it will take (150,000 - 47,100)/28,670 + 1 = 4.6 years to clear up all those 245i applicants before those BIG four contries can borrow visa numbers from world others assuming most of the 245i applicants are NOT from those BIG four countries.

So instead of 15 year's wait based on UN's calculation, there will be at least 4.6 year's wait.

Does this make any sense to you guys?

It is rumored that the number LC applications pending at BECs is between 200k and 300k. So even if 90k visas we made available today, PD won't move past 2001 April.
 
Man..this is sad. My case was changed from EB2 to EB3 at 140 stage. Seems like I shall be stuck forever in EB3 due to my lawyer/HR's mistake :(
 
EB1 visa dates

Good to see that visa dates available for EB1 is now July 2003. I have a question. Does it apply to all who has PD in the month July 2003 (EB1)? or Just whoever before July 1, 2003 PD.
 
Wha's up with EB2

What happens to EB2, with all these calculations done before in this thread showing years for approval, in best case scenario, at least 4.6 years. Are all these calculations bases for EB3? What is the scenario for EB2 in that case.
