Visa Bulletin & EB3

My prediction is that EB3 will jump 4+ months for most countries in the August VB - is this a fair assumption?

Right now this is how it stands:

EB1 01JAN06 (IN)
EB2 01MAR05 (CH), 01JAN03 (IN)
EB3 01OCT01 (All), 01OCT01 (CH), 15APR01 (IN), 22APR01 (ME), 01OCT01 (PH)
- rest of the 3 categories/countires are C.

EB1 India will probably be Current, although it hasn't moved much in the last few months. China EB2 will most likely be in the 2006.

Just my analysis (u can tell I have nothing much to do!).
Any comments are welcomed.

I just have to hope that these people they start to move faster on all aplications , because i don't think they will do much progress will all this backlog !!! They proof to everybody their luck of progress on this matter !!!
Just keep hoping for the best !!!

Good luck to everybody !!!

You're being too optimistic - atleast for EB3 - India I think it would move a month at the most - or just another week at the least.

Since it's the end of the fiscal year, if EB3 makes any dramatic shifts it will be backwards, not forwards.

Hi TheRealCanadian ,

Probably you are right on this , i think that's why they are pushing on this SKILL Bill !!! , but nobody knows for sure what they are doing there !!!
We just keep hopping that they will do something about this !!!

It won't be passed before the start of FY2007, and I don't see any impact even if passed until Q2 or Q3 of FY2007.

Well, if you look at the pattern - they are trying to make all Current. I don't think they are sitting around (although at first I though so) as some of the countries visa moved as much as 6 months at a time.

My only concern is that to handle the illigal cases, it may slow down the legal processing.

Priority date becoming current at VSC has not proven to be of much consequence at least to me. My PD has been current since May 1. I still haven't received my I-485 approval. Haven't received any RFEs either. My I-140 took a long time (10 months) as well, considering it was EB-1. No RFEs there either. Looks like my case is being processed by an Officer who is moving very slooooooooooooooowly:-)

You are right at first.
One common way for not getting approval even when the PD is current is that you got stuck in the name check - I saw your signature that you are inquiring USCIS, have you ever thought of contacting FBI (name check) and your local representative, given that your NC is not cleared?

Hi,

I am also beginning to think that may be I am stuck in name check. The problem is I don't know whether I am stuck in name check or not. That was the reason for my USCIS inquiry. I will check the postings on this forum to see how I can contact the FBI.

Found this link to NC FAQ posted by someone. Download the name check-faq.pdf from the first message, it has helpful info.

There have been very few approvals in the past couple of months despite the big PD shifts they made. I think the only reason they advance PD is to get more I-485 applications filed so they can cash the checks. They don't even care that the filed applications exceed the anual visa cap, because they can always make a retrogression later, once they think they ripped enough money. That's just my twisted view of the things. :o

Finally Moving

Finally, we, EB3 people see some lights, while others wait.

September VB is out with a 5 months jump.

Happy to see that.

Huh!

5 Months!! ? I see 14 days!
Which country are you talking about?

how long before I485 RFE gets accepted or rejected. Does anyone know.
thanks

I think they'll specify on the RFE itself. It may vary from case to case.
I recently recieved RFE for sending pictures for I131. On it, they specified for 12 weeks. By that time I'll have to submit or it will be rejected.

However, someone in this forum observed that the sooner you send it out the faster they handle cases.
