Victimized by TSC - Case xferred to Local Office

Folks -

Case transferred to local office (ATL) after a 33 month wait for scheduling and conducting an interview. Scheduling can take months. Can you believe that - after 33 months!!!

What could have triggered this. NIW, address change, job change, or all of this. Any comments...

Aside from that - how long more to wait. Can we ever move forward? Any feedback will be appreciated - specially the timing. Local office seem to be processing July 2001 and receipt notice date is May 2001. Will transfer date take the front seat? Hope not. I feel like I am going to puke...

That is pretty unfortunate. How about "the cup is half-full" attitude? As they are processing July 2001, allow one month for the physical file transfer and then take a stroll to the local ATL office and demand an interview to be scheduled as your RD is May 2001. They will be willing to oblige because your RD takes precedence over the transfer date. And do not forget to post your experiences at ATL office.

At times, they need to run their criminal background checks etc., which may delay the scheduling. But for that, you should be able to get an interview date within a few months from now.

That is very unfortuante.. (It was my worst dream..). As poon said, wait for a month and then if nothing happenes, you can contact local Senator or Congressman to consider your case. Ofcourse, your RD takes priority.

My attorney's take on this issue is that select number of cases are marked for auditing and fortunately, I was selected! Shame on me, I did not spend my buck on a lotto ticket that day. I should have installed the PERL code and had my computer page me as soon as they changed the message!!

He thinks, we (he) should get a notice soon (?!!). Once the files are physically transferred to ATL, an officer will be assigned and the fate of scheduling the interview will purely depend on the mood of that officer. How long it takes to get the files and assign to an officer is anybody' guess. He suggested walking to the front desk there and demanding an answer. Shouldn't he be doing all this??? That is the truth folks, you got to be ready to take such shit from all sides.

This opinion was more or less corroborated by the so called information specialists at BCIS.

I am looking for some real feedback. Is anybody else in the same boat? Please come forward and shed some light...
 
A respected senior member of this forum got his transferred to Atlanta on 10/2002 and is still awaiting call for interview. However, that may be because he may have had a later RD than yours. Others who got transferred in late 2003 and early 2004 haven't reported any call for interviews yet.
 
I can feel your sufferings. I have the similar experience. My case is also NIW case, which got transfered to Miami in last April. I am not sure what triggered the transfer, maybe due to NIW, maybe due to my last minutes marriage at I485 step. I went to MIami INS in person to check the scheduling status last year before Thanksgiving, and they told me I need to wait for another six month to one year. But I received the interview notice about 10 days after my visit to Miami INS, I don't know if it's triggered by that visit. Both I and my husband had the interview in middle Januray, and got passport stamped on the same day of interview. Both of us received the plastic card in the first week of this February. One thing you want to make sure is if you changed the address, you also need to update it with the local INS, my interview notice was sent to my old address, even though I updated my address change with TSC, fortunately the post office forwarded the mail to me.

I guess nobody really knows for sure why they transfer a small number of cases to local offices. It seems pretty random to me. Someone in this forum speculated that NIW cases are likely to get a transfer but there is no real proof for that. My theory is that they just transfer a certain amount of files to local offices for auditing, sort of like what IRS does with tax returns. What do you guys think?

Relax. Don't get too worked up.

Even my case has been transferred to the loca office (Dallas) a couple of weeks ago. Per my lawyer, the local offices are trying to schedule interviews. They USED to take months to actually transfer the FILES but these days, the count is in days. In our case, the FILES were transferred within a week after the cases got transferred to the local office. So, just hang in there.

Jaysee is right that files transfer quick. I concur to that. My case transferred to Miami office on Dec 15, 2003 even though I am here in Tampa. I contact Miami office first week of January, they confirmed that they (Miami District Office) already transferred my case to Tampa office.

I visited Tampa District Office on Jan 12, 2004, and they confirmed my I485 pending in their office here in Tampa. However, I haven’t heard anything, as far interview etc. is concerned, from Tampa office yet. My fingerprints expire Middle of next month. I hope to hear from Tampa Office before that. Keep you all posted!!

Just walk into Tampa office (Cypress Street) and ask if your case is in Tampa. I bet million bucks your case is pending in Tampa office. Do'nt need to go to Miami. Let me know what you find out.

This does NOT look 'select' number of cases.

There are several of you - from same time spand - How it is 'select' number of cases.

I am not sure if that theory is correct.
 
Case Transferred to Miami, FL

It is actually my wife's case.

NC 9/01
FP 3/02

On Feb 13th case was trasferred to Miami FL.

I dont know how long it is going to take. and I dont know why this was trasferred.

I am the primary and was approved in oct of 01after we applied for her I485.

Lets hope for the best.
