Hi Gurus
Pls Help. My wife is in H4 Status. She got a job. the owner agreed to sponsor her. But the company has 10 employees. and income is 150,000 us dollar per year. No one is in H1bs. So my question is whether the company can file for H1b or not. what are requirements for h1b sponsoring for a compnay? PLSSSS Gurus Help me. The time is running out as the CAPs are almost finished.

-- it depends if the job comes under Specialty occupation, you need to post what kind of JOB has been offred, answer depends on that and for H1 she need to have BS degree

----you should go to lawyer, let him know the job skills and education of your wife, ( you will need education evaluation done in US) and he will be able to help you. I dont have full details of job and your wife education. CAP may hit any day

She has her BS done from US in marketing. so employee number is not a problem. Is there income of the company is a problem? It seems to me 150,000 us dollar income is low for H1b sponsorship. Can you please tell me whether she can get the sponsorship from the company or not. they never sponsored anyone. Thanks a lot.

Whose income is $150,000? To qualify for H1B, the industry standard for the job must be a minimum of a baccalaureate degree. The prospective employee must possess that qualification. The company must pay at least the prevailing wage for that position in that area (usually established by the local SESA). You obviously have H1B...if an attorney helped you to get it, check with him/her!
