Very Urgent - H-1B Premium processing

I run a small company with revenues of approx $250K a year manufacturing speciality gift Items. I had a web developer working for me in India who designed our current website. We recently decided to launch our business on a broader scale and are considering to bring the person from India as he understands our business. This will be a New premium processing H-1B that we would be doing to bring the person on board as our employee. Right now I just have 2 people on payroll and have been using temporary workers as part time workers.

I heard the H-1B is a problem now? What are my options. I checked L-1 may not work here.

Will the person easily get the H-1B stamped and approved. I heard that there is some problem at US Embassy in Delhi.

I would appreciate earliest response.

You need a brick and mortar outfit apart from revenue to get a visa. Your first hurdle is to get the LCA from dept of labor and H1 approved from BCIS. Only after the approval, does US embassy come into the picture...
Consult a lawyer.

I would appreciate some clarifications here. What is the meaning of Brick and Mortar outfit here? and what are the other things that are needed?

An office... physical address and location Most of the rejections are for companies that exist only in paper...
