Yes, you can stay legally without having EAD
As long as your 485 is still pending, you can stay in US without having EAD but you cannot work without EAD. If I were you, I would go with paper filing. Paper filing does not require finger printing where as efiling requires finger printing. Only advantage with efiling is, you get the receipt number immediately where as it may take up to 2 weeks to get a receipt number for paper filed EAD.

i765 is eligible for premium processing, but uscis has not decided when to begin and end the premium processing.
So I dont have any choice other than not working till i get the ead. If I dont work, am I still maintaiing my legal status ? reason Im asking is shouldnt I be employed all the time till I get my gc?
