Very Urgent! Can someone help me out from FBI NAME CHECK pl!

Just now I receied an email from FBI (NAME CHECK), stating that, USCIS has not initiated any name check for all the members of the family:mad: , RD:03/20/03, Can someone shed some light on pro's & con's. Needhelp 1 & rajudm, any of your help is greatly appreciated.

With your RD, you should be able to initiate a status inquiry at the VSC if you haven't done so already. Perhaps, you can ask the call center people to note on the inquiry request that the FBI is saying that your name check hasn't been initiated.

It might also be worth asking the FBI to check again (send them another status request email and/or fax) just in case they made a mistake at their end. Any chance you gave them the wrong alien number or other information?

I read elsewhere that it is not a good idea to hint the NSC that you had started enquiring FBI about the name check. That might get them peeved.

vijrek, but I still think it is a good idea to call NSC and initiate an inquiry without mentioning that your namecheck might be pending.

On the other hand, try getting in touch with your local reps (Senator, congressman). They might be able to put some pressure on CIS to work on your case. I believe "needhelp1" is in a similar situation as yours. Try getting in touch with him (may be send him a private message).

A review of the FBI's Name Check Program database concerning (NAME) does not indicate that a request has ever been received from the United States Citizenship and Immigration Services (USCIS). Therefore, you may wish to recontact the USCIS local office for further processing of your case.Any other input/ suggestion is greatly appreciated.

Can someone throw light on why this is so so so urgent when there are
folks with RD's of May-June-July-Aug-Sept-Oct 2002 who are in worse
predicament ?

I have received another email from FBI yesterday saying that my Name Check has never been requested and my spouse name check was request on march 2003 and it was cleared on the same day.
I have initiated a status inquiry through my congressman and hoping for the best. Don't tell USCIS that you have been following up your case behind there back as this will really make them :mad: and they might neglect your case.

So the best way is to try to make them review your I485 case. If you have not applied your EAD, this is the time now and also contact your rep at www.house.gov and type your 9 digit zip code and it will list your representative name.

Good Luck to you! Don't get scared as you are not the only one now. I was the first one and then rajudm, chakal2000 . So we should become a group and try to talk to each other when there is any developments and help each other.

You are right SumanTA, it wil improve things, but it will improve for everyone, for people with ND in 2003/2002/2001 and also for 2004.

We just can never figure out how USCIS works... :mad:

It's quite possible that the missing name check will hold up this case. These can take up to 18+ months (if there is a "hit" against the FBI database) and if it really hasn't been initiated yet it is a very good idea to follow up on this. Usually the name check is initiated when the I-485 application is received and usually they take about 1 month to complete.

Actually I have been in this forum from the past 3 years and tillnow I haven't see one person mentioned clearly why his Name check was never requested with a valid reason.

This is really a negligence on part of USCIS and if you see my case, they have mishandled our cases and we are now paying the price for there mistakes. They have sent my spouse name for Name check back in March 2003 and they have not initiated my name check yet. Yesterday I got another email from Mr.David Hardy's department confirming what I said above.

The only way we can make them work on our cases is to file for EAD renewal or apply for another AP and try to contact the local representative and also write emails to Mr.Khatri and also we should ask our Lawyers to contact AILA Liason about this negligence. But we should never tell USCIS directly that we have been following up our cases behind scenes, which will definately irritate the IIO and he might neglect the case totally. I have seen some instances where some of our forum members have been harassed for long because of IIO's deliberate intention. So think 100 times before making anymove against IIO directly. My 2 Cents!

I sent to FBI on sep 27th & they replied on 28th of this month. I initiated an enquiry this morning, with NCS, Lets see whats going to happen.
