My employer is a manufaturing company, they sponsered my GC. I have been working with them for last 4 years. My 485 (PD 2004 -EB2-India) is pending for more than 1 year. 140 is already approved. I already used AC21 for employment relocation, with same GC sponsering employer (state to state transfer). We informed USCIS about my emplyment relocation. This happened 4 months ago. Now my employer about to lay off me (may be today), due to their finiancial constrains. However, they may support me in GC, in terms of documents. I am not a IT guy, it takes some time (may be 1 to 3 months) for me find same or similar job. In this situation what kind of support I should ask from my employer? Can I get a letter saying that "I will be hired after I get permanant residence, till then I will be in leave of absense"? Can this letter help me to maintain my status..Help me please.. Thanks...

----------- you dont need any documents from past employer if possible get the Copy of LC ,I-485 filing reciept and I-140 approval notice, you are eligible for AC21

------------the letter from past employer may not help, try to get new job ASAP and then again invoke AC21 with new employer letter.

I have copy of ETA 750 A and B, copy of approval notice of 140 and receipt of 485. Therefore, I know my job classification and duties.
The difficult part for me is finding the same or similar job with similar salary, as most of the job require citizenship. I am trying hard. I do not know when I will get. In between, if USCIS asks for EVL, I do not know what to do..

Gc_puli.......dont pay too much attention to the same or similar job........try to get a job in your career field (if you are a programmer get a programmer's job.......or a project lead job...).....you will atleast have a employer......you can consult a attorney on how to present your case in case uscis needs EVL
