Hello everyone,

I have a 2 years Condition Permanent Resident, this Green Card expires in October. I have to file Petition for "Removing the Condition" in July, but I'm out of US for 6 month already. I'm planning to go back in middle of April, so I'm gonna be out of States more than 7 months.
1.What kind of problems I will have when I cross the border?
2.What kind of problems I will have when I will file the Petition?
3. Should I bring documents from hospital ( I was sick) on interview?
4. Can they deport me or will not five me 10 years visa for being late?

A1: They might want to know why you had a prolonged absense from the US.
A2: If you return to the US in April (and stay in the US) and file an I-751 in July, I see no issues with that. I am assuming your marriage is still intact.
A3: If your prolonged absense was due to a health issue, then please carry those documents when you return to the US.
A4: Not for a 7 month trip that was due to a health issue.

As absence of less than 6 months is not a problem. The absence of over a year is. Between 6 months and a year is fuzzy and at the option of the border officer. Was your spouse with you for the 7 months or in the US during most of this time? I hope that you kept your residence, etc. In addition to the medical papers, carry your lease or other documents to show you did not abandon your home as additional documentation; it is unlikely to be needed but will give you an additional feeling of security.

Most of all, don't worry! Everything should be fine, and if you are recovering from an illness you do not need the stress. Traveling is stressful enough.

Thank you very much. I was sick and still sick, and my baby was sick as well, so maybe I will take all papers, as you said for "additional feeling of security" :-)))) I like it very much! Thank you!!!!!

Thank you very much! Yes my marriage still intact, trying to work things out....don't know what's gonna happened....hope everything will be fine!
