Very difficult Visa Situation

Here are my details, appreciate your help in this regard.



Srini's Status

· L1B was valid till May 2006 (maxing out - 5yrs)

· L1B to H1B was filed by his company in Aug 2005. It was approved in Aug 2005 itself with an effective start date of 01Feb2006



Priya's Status

· L2 was valid till May 2006 (maxing out - 5yrs)----was working with EAD based on her L2 visa. The EAD vaility is till May 2006

· L2B to H4B was filed by Srini's company in Aug 2005. It was approved in Aug 2005 itself with an effective start date of 01Feb2006

· At the same time we applied for L2B to H1B for Priya through another company (receipt date 10Aug2005). Even after 150 days we did not see update in USCIS.gov site. So, we even applied for Premium around Feb 2006. But no response yet.





So, in summary....The current situation for Priya is...

· Priya's H4B is effective from 01Feb2006

· Priya's H1B processing.... is still in progress according to USCIS status

· Priya's has a L2 based EAD card in which the validity is till May 2006



Questions:



a) Can I continue to work...even after 01Feb2006?

b) If I am not supposed to work beyond 01Feb2006 but since is continuing to work, what are the repurcussions?

c) Are there any work arounds for me to continue working?
 
Are you srini or priya ?
And did srini and priya get new I94 attached to H1/H4 approval notice ?

Very strange situation

Actually this is from my friend.

Srini and Priya both got H1 and H4 with New I94.

Priya applied for H1 and still did not get it approved.

Is your question asking if Sriri can keep working for L1 company or if Priya can keep working for EAD company ?

OK, probably it does not matter which of them you are asking about.
Both were on L1/L2 and now changed the status to H1/H4 and they currently are on H1/H4 status as I94 was attached.

Srini can not work for L1 company. If s/he wants, s/he needs to change back to L1.
Priya can not work on EAD as s/he is not L2 status anymore.

My apology. I missed the point that Srini's H1 company was the same as L1 company. Srini can keep working for L1/H1 company, however, Priya can not as s/he is on H4.
