Hello! This is my first post. I have a few questions that worry me everyday. My lawyer moved and never picks up the phone, and other lawyers want to charge me hundreds of dollars for a few questions. So I thought I'd try forums.
I had my H1B approved earlier this year, but I also have a B1/B2 visa before that. After I graduated from undergrad in Canada (I am not Canadian or under NAFTA for that matter) I came to the States for vacation until I can start working. The custom officer gave me an I-94 based on B1/B2 visa. I never left the States after that, I just went straight to work.
So after a week of working, I went to the SSN office to apply for a SSN card. They took my information and asked me to wait for mail. According to the receipt they gave me, I should be receiving something in the mail in 2-4 weeks. After two weeks of waiting, I went to the SSN office again to find out the status. The officer told me they have not heard anything, but other ppl who have applied already received it, and told me to wait again. Now it's been six weeks, and I called the SSN 1800 number yesterday, the officer said he cannot check the status of my SSN number, and told me to wait as well.
Question 1:
How long should I expect to wait for my SSN number? If I don't receive it what can I do? My employer can't pay me without it. What if I still don't receive anything in 2 or 3 months!
Question 2:
I have the 1-797C letter that was sent to me, but they call this a courtesy copy. The "original" that was sent to my lawyer is apparantly lost! I used when I went to apply for the H1B and I don't remember if they ever sent it back. If it is lost, how can I get another copy? They need this for SSN number don't they? and if I leave the country and wish to re-enter?
Question 3:
Do I need to leave the country and come back in again to receive another 1-94 specific to H1B? If yes, then I would have to apply for a Canadian tourist visa? Or can I just say I want to get another I-94? Is this what is causing the delay in my SSN card? The SSN officer adviced me not to leave the country or I might not be allowed back in.
Question 4:
I've read in threads that I cannot work another job with my current H1B. But with SSN number, can I say work at Starbucks with it? Someone is pressuring me to get another job, but I have a feeling its the same penalty as using H1B to work another job. Does anyone know the consequences of using my H1B SSN for another side job? Or how the government or employers can detect this is not right? The SSN officer I contacted yesterday said I can use the SSN number for another job... So this has me very confused. I really want to explain to the person pressuring me that I can't, but I don't know how.
Question 5:
Is it true that I can study part time while on H1B? The custom officer told me I can, but the officer that handled my H1B said I can't. If I can, can I apply for internships as a part time student on H1B?
Thank you so much!
