Verifying Labor

Hey guys,
According to my company, they have filed for my labor certification in Virginia and have given me an eight digit case number. Now my questions are:

(1) How to verify whether they have actually filed the LCA?
(2) If LCA has been filed, is there a way to determine whether it was filed as RIR or non-RIR?

My company does not like to disclose this kind of "sensitive" information (not even to employees) so I am kind of stuck.

Any help is appreciated.

Thanks,
Stewart Rogers

(1) How to verify whether they have actually filed the LCA?

You can call SESA and find out with your given case number. But some time they will say they can only talk to your attorney and employer.

Virginia SESA
(804) 236- 2717
(804) 236-2709 FAX

do the same.

You can also go to following page, and enter your state/employer http://www.flcdatacenter.com/casesearchperm.asp

In "Fields To Return" tick "ALL" option - scan the resulting page for your case number. You can also check based on your date of filing.

The data here is not updated frequently, so if your case was is not yet here, you dont have to hit the panic button.

Also if there are a lot of cases (>100) for your search criteria, you will have to download the results as text, as it will not show all the cases as HTML caeses.

Mistake in my previous message.

Read "LC" (which is for green card) not "LCA" (which is for H1)

Thanks.

Stewart__Rogers,

Is that a SESA case number or a DOL case number?

As TAMIL_GC has specified - you can call them and find out the status. Try to avoid calling if it is too early. I feel that since your employer has given you a case number - it is reasonable to belv that they have filed.

All right; so as far as my understanding goes, Labor is first filed with SESA and then it goes to DOL. Correct me if I am wrong but SESA means "labor which gets processed @ state level" and DOL means "labor which gets processed @ federal level".

* How would I know that my labor has been forwarded to DOL?
* If SESA and DOL case numbers are different, then when should I ask my employer for DOL case number?

Any thoughts?

Thanks,

SESA and DOL case numbers are indeed different. If you want to get info about your processing - either make a call yourself or ask your employer/lawyer.
