Validity of H1B Extension if I485 is rejected

My case is like this. I have I140 approved and 485 pending.Labor filed in oct 2002 in EB3. Working in EAD since H1 expired. Since I485 is in retrogress my company adviced me not to file for an H1 extension since they feel that 485 AOS may come either this year end in Dec 2005 or sometime early next year. I am worried that if for some Reason I485 gets rejected then should I file for an H1 extension now or there is no point since even filing an H1 extension does not help if 485 is rejected.

if it is beyond 6th year and on the basis of pending petition. it doesn't matter as per yates memo and H1 gets invlidated

If somebody is about to complete six years in few months, and visa will expire before that and I-140 is approved and I-485 is in pending for more than 180 days.

1) Will visa extention helps in case of 485 is denied

2) visa will also becomes invalid with 485 denial

You should get a H-1 extension. Even if your I-485 is denied, you will be in H-1 status.

I too have the same Question ...How this H1 extension works

If H1 extension is based on pending I140 or labor or I 485..., If any of these these (485 or 140 or labor) get denied .., then how this H1 extension will be valid???

We need some advice on this to understand ? Right ??
