Valid RTD & Valid Rentry Permit OK!!

I have a valid RTD that expires in August 2006 and I have trips planned in May 2006 & September 2006. I made an infopass appointment at my local USCIS office to ask few questions, The officer was very very nice and helpful.

You can have a valid RTD & a valid Rentry Permit in hand. He said that they both are entirely different things and you can have both documents in possesion. You can't have 2 valid RTDs or 2 valid Rentry Permits. But you can have 1 of each.

I am applying for RP now based on our conversation. I even asked him that why does it say in the I-131 that you need to return it. He said that the directions are confusing, that form is both for RP & RTD and you can't have 2 RP & 2 RTDs at the same time. He also said, if you send your valid RTD & request a RP, USCIS has no obligation to send the RTD to you since you can have both valid documents. Its up to the applicant what he wants to keep or not.

Ofcousre RP is for PR's only. I also asked bout renewing NP and he said you can renew it since you are not an asylee anymore.
 
I wish they can post their claims on the INS WEBSITE . As soon you renew your NP then they might use it against you.. They need to address this issue by posting a memo on their website..

This is what he said exactly cuz i wrote it down :)

"The obtaining of a passport from your native country is only indication of your ability to return there. It does not mean that you could not still be persecuted if you return there.

If there is nothing else, it is highly unlikely that USCIS could seek to rescind your asylum status. "

I think by nothing else he meant fraud etc.

With all due respect, this should not be the only issue we should seek a clarification from the INS (not less than via an official memo!). We do not have any official pronouncements or permissions from the INS on the following, therefore, in addition to the memo on the use of NP or visiting COP, we should get clarifications on:

1. Can we make phone calls to our COP?

2. How about letters? Will writing to COP be tantamount to "availment of COP's protection"?

3. Can we send money and remittances to our relatives through Western Union as such will be somehow "contributing" to the economy of the COP?

4. [This was discussed at length before] can our corpses be sent to be buried in our COP when we die?

5. Can we attend a movie or a musical cultural production from the COP which may be somehow sponsored by the regime back home? Will paying the entrance fee be tantamount to "supporting" the regime?

6. How far (in feet) must we be while passing the embassy or consulate of our COP in the US cities we live in or visit?

Online soldiers, please supplement this list. I want to get this letter out to the INS ASAP!

I agree with some issue you raised but The NP is more critical and we all know that NP can be used as identification purposes..

I honestly think that INS dont know what to do but they need to hire new staffs that can resolve immigration issues..

With respect to having a RTD and a RP together, what the officer told you is not consistent with the real experience of a forum member. See this message:

The operative language of the regulations (8 CFR 223.2(c)(1)) can be read both ways.

Tort,

What about reading on-line news from your COP, or having thoughts from your childhood in COP, or thinking about your old mother who still lives there. Is it permitted by USCIS? May be they will deny my citizenship when they ask in the interview if I ever did any of the above. I'm really scared.
