VA Job renewal after initial 3 yr H1B

Does any one know if the VA has to repeat the whole process of recruiting efforts->VISN->Health Revenue Center, Topeka->Central VA before they can give out another 3 year contract (H1B) to a J waiver physician (after his/her initial 3 year H1b period is over).

I am asking this because my VA H1B is presently filed under regular processing and I am not planning on expediting it through premium. Ideally I am supposed to start July 1, 2006 - June 30, 2009. Now that July 1st is round the corner and the H1b/USCIS J-1 waiver is pending, my approved H1b period will be shortened by the duration of the time USCIS consumes beyond July 1 2006 in adudicating my case.

Also my question comes in the light of the fact that VA handbook manual mentions that the J1 waiver physician can be given an extension of NTE 3 years if they (facility) still have recruiting difficulties at the time when the initial H1b (3year) is over. Thanks for listening.
 
Everyone I know who did his waiver with the VA had the opposite problem: The VA doing everything they could to not let you go !

This will go to different levels depending on their degree of desperation. Some people got offered to work 3 days at full pay (+1 administrative day), others where offered some sort of 'scarcity pay' or promotion to 'chief' if they stayed on. (for a few, the VA turned ugly and tried to throw their weight with USCIS around to screw the physicians immigration case if they didn't sign a contract extension).

I don't think you will have a problem to get a couple of months of contract extension from the VA. I don't know their inner workings, but to me it seems that once you are in, you are in.
 
What about PERM with the VAs

Thanks for writing. I am going to submit the NIW-I-140 once I begin in the near future. But would also like to pursue PERM processing. What has been your experience with the VA doing the PERM ? Is it ok with their policies?
 
Don't know whether they do LCs. They will tell you that 'they can get a green-card for you' if you just sign for 5 years.

I don't recall anyone getting their GC through LC. I have heard of 'outstanding researcher' I140s filed by the affiliated university and 'plain vanilla' NIWs based on research accomplishments.
 
Wife's own H1B next year -> LC GC (For HADRON)

What if I add my wife to my NIW-I-140 this year to establish the priority date. And next year when my spouse starts full time physician on H1B and does LC GC on her own (me an add on her application). Will she be able to use priority date from my I-140 (NIW) of this year to process her PERM based processing? She will be 3rd (final) year resident this year beginning july on H1B after my waiver is approved! The whole IDEA IS TO USE THE PD FROM MY NIW I-140 (SHE IS ADD ON TO MY APP) AND USE HER PERM TO PROCESS GC (ME AS AN ADD ON TO HER APP) to cut short the time. If need be she can another I-140 but keep PD from MY NIW-140. Thanks
