Dear Immigration Law Experts,
My wife is a green card holder. She filed a green card sponsorship petition (I-130) for me in Dec 2000.
The application confirmation notice has following details:
Received Date
Dec 18, 2000
Notice Date
Dec 22, 2000
To be eligible for the V1 visa, the sponsorhip petition should have been filed on or before Dec 21,2000.
My question is, would I become eligible in Dec 2003, for the V1 visa? If the INS considers the Notice Date then I am not eligible. But if the received date is considered then I would be eligible.
If I would be eligible, then when (how early) should I apply for it, considering I would be applying from US?
Someone please clarify my confusion.
