Using Petitioning Employer's job experince

I have a Masters with 4 years experience from my current employer.

The attorney suggested we use some of that experience which was gained at a lower level. (I have 3 years as a senior and 1 as a manager) The attorney is proposing that in addition to the Masters that we advertise with an additional job requirement of 2 years experience (which is not unreasonable from a job specific perspective)

I have read else where on this board that using the experience gained at a petitioning employer's through the "substantially different" exception, will automatically throw the petition into audit. This is what concerns me because I dont like disputes and controversies.

However the attorney assured me that she has done this on several occasions and has not had one of these petitions using the experience gained at the petitioning employer put in the audit track.

What has been others experience in this area?

Whatever you do, do not use experience with petitioning employer. If you have prior experience after Bachelors, use only that.

That is what I have read every where. However my firm's attorney insists that she has never had such a problem and attributes audits to poor attorney skills.
