using FOIA (and who would get RFE)

My 140 get cleared and 485 was filed more than 7 months ago. (EB3/VSC).

I am planning to look for better offers. Currently, i do not have any documents except for Receipt numbers of 485,131,and 765 (for myelf and my wife).

1. Should i invoke this FOIA (one for me and one my wife ) (wife was not employed) - I need to confirm


2. Suppose, i get the docuemnts for INS and later get decide to continue with the current employer - and in case of RFE , who will get it (me or the attorney?)

3. Is it needed to have a attorney (in my future employment)??

4. Are these docuements needed to file AC-21. (labor ,140). Would they be useful later on?

----- I-485 belong to YOu and your wife, ask the I-485 filing reciepts from lawyer/employer, it will be better if you also get LC approved copy particularly form ETA750A that has your skills in item 13 on it, try to get copy of I-1`40 approval from lawyer or employer, no need to inform that you are thinking of changing employer. if they dont give use FOIA

----- you only need documents for you as you are primary, if your wife has I-485 filing reciept that is enough for her

--no problem, the lawyer who filed I-485 will get RFE if any

----- if you change employer better hire YOUR lawyer and fill up form G28 with him so that he can update USCIS with your I-485 reciept copies that he represent you and he will get the RFE if any and you can use his services to invoke AC21( you can also hire new company/future employer lawyer)

----- LC can be usefull particulary form ETA750A, many service center ask for I-140 filing reciept or I-140 approval notice copy when you file EAD or AP. By law EAD,AP is based on pending I-485
