Using AP when Renewal Pending?

Hi Folks,
Are there any issues with using AP when a renewal of AP is pending. I have read that you should be in the country when you receive AP (in this case the renewal AP for it to b valid).
In my case, I have AP until May ~1, 03, and I am hoping to use it for a trip abroad in Feb 03. Should I apply for the extension/renewal of the AP before leaving (along with EAD renewal that I am planning on filing next week), or wait to return from the trip to file the AP renewal.

PS: H1 expired and 6 yrs used up, so that is not an option for me.
 
No. You can apply for as much as APs as possible. You can enter US before expiry of any of those AP. Entering thus will not invalidate the pending AP.
 
Just be 100% (and I mean 100%) certain that you will reenter the prior to expiration of your AP. You cannot get caught outside the US without a valid AP under any circumstances (whether it is your fault or not) or you will lose your pending AOS. Be sure that you come back long before your AP expires. Plan for cancellations, missed planes, plane breakdowns and even terrorist threats. Don't take any chances with this since you lose your pending AOS and probably your ability to get back into the US if you are out of the US when the AP expires.

I will return about 8 weeks before the current AP expires. Also I will send the AP renewal application before leaving for about 2 weeks (EAD renewal already sent), so it should most likely be done only after returning.
