Using an existing LC

Hi,

I would like to know how I can use an existing Labor Clearance from an employer. Heard that the qualifications and experience need to match to that of the person for whom the LC was originally approved. I wonder if any of you have more details on that.

Some people say that if INS queries on the LC, that would leave permanent mark on my file like that, is it true?

Please let me know the complications involved in using an existing LC.

---- Education and qualification, skills, Exp should match and you should have that all the above before the LC was filed or on the date LC was filed. You need to get the copy of approved LC and check the ETA 750A and ETA 750B. ETA750B is most important and check what they have written in column 13, 14(education, degree and exp read all) and 15. see if that matches with your skills, exp and degree required

---- take the approved LC and your resume, exp letters ,education certificates and consult a good lawyer, it is not easy to reply without looking at the approved LC and your all documents

Hi,

I have been denied LC in RIR, currently, my company has approved labor and one of them matches my job profile, but the salary and the job position is lower than the current job profile. To transfer the approved labor, does it mean that I need to take pay cut and demote myself to fit into the job profile of the approved labor?

---- meet good lawyer with LC approved copy that includes ETA750A and ETA750B and approval page from DOL at top and your degree certificates ,exp letters, educational evaluations
but the salary and the job position is lower than the current job profile.
-----no problem if it is more than LC

--- No pay cut needed, GC is for future job after I-485 approval, and employer can pay more than salary on LA at this time or after GC
