Using 245(i) after 485 has been filed -Help!

One of my relative's husband worked for 2 hours (with company Y) while on H1 for company X.Company Y paid him a $100 stipend check.

No taxes were deducted from this check, and I guess no W2 was issued. However he is worried and wondering if there will be problem when his 485 comes up for processing. He filed his 485 about 4 months ago.

Please tell if this will be a problem, and is there a way to fix it. Please reply ASAP.Thanks.

Raja you can use 245(i) if the labor certification or visa petition was filed on their behalf after January 14, 1998, but on or before April 30, 2001. Also they should have been physically present in the U.S. on the date of enactment of the new law which was (December 21, 2000). Finally when you file for 485 adjustment of status you should have filed a supplemental form for 245(i) along with a fine of USD 1000. Hope this helps.
