Folks-
Can any one point me to the memo/law which says that use of AP void H1 status. I had a discussion with my lawyer and company's legal department and they (strongly) believe that use of AP does not void H1 and therefore I do not need EAD to work but can continue on H1.

Your help is greatly appreciated.

Thanks Ginnu-
The issue here is that after using AP I filed I-9 for iEAD. SO I basically switched to EAD. Now since my EAD is still pending, I do not know if just filing another I-9 with I129 as employment authorization has any impact.

-----I-9 is ONLY filed with employer H.R it is not sent to USCIS
SO I basically switched to EAD.
---IF you have NOT worked on EAD then take the I-9 from employer or let them shred it

Now since my EAD is still pending, I do not know if just filing another I-9 with I129 as employment authorization has any impact.
----- I-129 for employment authorization ??????? it is filed for H1 or H1 extension with USCIS. Idont understand your full situation
