Use Drop Box or tke Prsonal Interview in Delhi Embassy

I had an H1 which expired on Jan 15th.

My prospective employer messed up and did not apply before Jan 15th for a transfer and applied on the 19th Jan for a Fresh H1.

This request was denied because immigration thought my propspective job was not stable.

The same employer applied again for a new H1 again for me in another service center last week as they want me to go to a different project in another area.

This was approved 2 days ago but we have still not received the notice of approval so don't know if the I-94 is attached to it or not.


I know that since Jan 15th I am not legal.

I will have to go to India if I don't get a I-94 to get stamping done.

Since I had an H1 already stamped previously, I can theoritically use a drop box facility and avoid going to the embassy for stamping.
On the other hand, since I am in US illegally from 15th Jan and if that is found out by the embassy my visa can be denied so from that
point of view it might be better to take a personal interview and have the option to explain my situation to the visa officer,
rather than get a denial in mail and then try to get a second hearing. I will have to go to the embassy in New Delhi.

My wife has an H1 here, so if I get denial I can try H4 also although I don't want that.

What should I do?

I think I 94 could have attached to your approval notice> even in my case we have applied the transfer of H1b before the expiry of the old H1, but due to change in the form, and change in the petetion fee, it got delayed by 28 days, but i have received I 94 along with the approval,

then the only option u have is go to consulate abroad, and get the revalidation,
go to your home country and get it done, so that u dont stranded in the other country, in case petetion is taken for the administative processing.

Attornrnies suggest to go to home country if u do not have the valid visa, to re enter to USA

you seem to have totally missed my question and I'm not sure if you are aware of this.

The question is that there are two ways in India to get stamping done. One is thru drop box where you send the passport and all other docs by mail to the embassy and they send the stamped passport back to you. The other is to request a personal interview with the visa office at the embassy and get the stamping done.

My question is which way should I choose?
 
Ok, that depends on your personal choice,
the thing is when u get denial in the mail, you will have to take lot of documents, i think personal interview would be best option.
( i think u r aware of these all facts, as you are a frequent browser of these threads )
