I had an H1 which expired on Jan 15th.
My prospective employer messed up and did not apply before Jan 15th for a transfer and applied on the 19th Jan for a Fresh H1.
This request was denied because immigration thought my propspective job was not stable.
The same employer applied again for a new H1 again for me in another service center last week as they want me to go to a different project in another area.
This was approved 2 days ago but we have still not received the notice of approval so don't know if the I-94 is attached to it or not.
I know that since Jan 15th I am not legal.
I will have to go to India if I don't get a I-94 to get stamping done.
Since I had an H1 already stamped previously, I can theoritically use a drop box facility and avoid going to the embassy for stamping.
On the other hand, since I am in US illegally from 15th Jan and if that is found out by the embassy my visa can be denied so from that
point of view it might be better to take a personal interview and have the option to explain my situation to the visa officer,
rather than get a denial in mail and then try to get a second hearing. I will have to go to the embassy in New Delhi.
My wife has an H1 here, so if I get denial I can try H4 also although I don't want that.
What should I do?
