USCIS Reaches H-1B Cap

February 17, 2004

Washington, D.C.-- U.S. Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B petitions to meet this year's congressionally mandated cap of 65,000 new workers. After today, USCIS will not accept any new H-1B petitions for first-time employment subject to the FY 2004 annual cap.

GREAT NEWS!

1) INS will transfer workforce from H1B to I-485
2) It'll be more job opportunities for us EAD holders

:)

Reaching the cap means they will not accept the petition from 02/18/04, it doesn't mean they have processed all petitioner of H1B. I think tyey still need 2 to 3 months to get all H1B processing done.

I am sure they will take this opportunity to reduce the H1 backlog before hitting the 485 backlogs.

Before celebrating I would wait till I see any backlog movements!

Given the slowness of USCIS most of the H1B are premium processing. Hope atleast those personel will be moved for 485 processing.
