USCIS Mistake

USCIS denied my case because the document i sent them didn't look real, (calling document a copy and not original) but I have proof that it was a real document. However, beacause of that mistake i had to file a motion to reopen/reconsider 5 months ago and i haven't got no response from the uscis.. what is the next step. We have already contacted the ombudsman and he has sent 2 inquiry to USCIS, the last of which requested to expedite. Uscis still has not responded.

FYI our interview and everything had already been completed and the officer said he was approving our I-130 but only needed the additional document we sent him for the I-485.

Actually something similar happened to me back in 1995. I showed them my passport with entries to other country proving that I had not overstayed by B2 Visa entriy, however the INS claimed that they were fake stamps. I was lucky enough that I had kept some old documents which included an airline boarding pass and a police report of an accident I got into while outside US.

I am not familiar with troubles of this sort (yet), but my humble suggestion would be to involve all your senators and local congressmen, and by all means the First Lady!, in this. The First Lady seems to be the most influential of them all. Ask them all to help you, so they will start bombarding the USCIS with requests on your behalf, most probably you will have a positive result very soon.

Did one document have a problem or many?
and what document was it?

I lost my first I-129 (partially teared off) so i have to use copy of copy and did not have a problem. i am not sure what my lawyer did it. i will ask him.

There was no problem with a document. I just had a reciept for fine rather than the court disposition for a misdemeanor at the interview. So the next day I got the disposition with raised seal and sent it to USCIS. We then did not hear anything for months and continued to try and contact them to ensure they reiceived the disposition. After 3 letters, 2 info passes, 1 official inquiry, and numerous phone calls we were still ignored for 4 months. Then they suddenly send a letter saying our case has been denied due to abandonment for not having the original disposition ( supposedly only a photo copy) in on time. Thankfully we have proof of all the correspondance and of the disposition being sent 2 days after the interview. But we still are being forced to wait an undefined amount of time.
