USCIS has returned 485 application

Hi All,
Lawyer sent my application on June 21th but the USCIS sent it back on July 17th around because numerical amount on the check is not matching with the written amount. they sent a notice explaining the reason why they are sending it back and asked us to include a copy of this notice when we resubmit the application. there is also a file no AXX XXX XXX on the upper right hand corner of the notice.

This monday we resubmitted the application with the notice received from USCIS and they should have received it by now. When it is received again, would they consider the original sent date for issuing received date since the notice has some file no AXX XXX XXX. Please share your thoughts. Thanks.
 
I hope they will honor the RD LoveNY! My application (sent on June 27th, PD was current in June) was sent back by USCIS on August 10th! The dork attorney took 4 days to re-send the package, and I hope he did overnight this time!

I did see an update on my I-140 on August 5th. Doesn't mean that they will automatically honor the original RD.

If they don't, then I will be at the bottom of a huuuuuge pile of applications!

USCIS policy says that Receipt Date for application process is the date when they receive a complete package of application, if there is a missing basic documentation required (ex. medical exam or birth certificate) for I485. However, your case is incorrect $$, so it depends on your luck.

I asked my lawyer if I am going to be behind all those applied in that one month period, she says it mainly depends on the cutoff date. so I think we will be fine unless they make it 'current' which may not happen in near future.

From your signature, I-140 is already approved, is this your second I-140?

No .. they returned my 485 package. I am still trying to find out why, from my lawyers.

Hi,

What was written on the checks? When I sent for 395.00 I have written "Three Hundred Ninety Five and 00/100 only"? Will it create any problem?

thats good.
In my case, my company issued the check and they wrote "eleven hundred and 00/100 only" for $1140.
