USC marrying H1-B

Hi,

I am currently a USC in California planning on marrying my fiance who is currently on an H1-B. I recently received a great offer to go work in Seattle. Ideally we would get married (and file all appropriate AOS papers), she would quit her current job, and we would move up to Seattle ASAP.

Is the scenario above viable, or is it easier if I move up first and she works on her H1-B until AOS is completed before quitting? My primary concern is whether quitting her job (immediately after acknowledgment of AOS application) will make the AOS process more difficult.

Thanks!

Whatever you do, after you guys get married you must live together, to prove a bonifide marriage. Living separate even if for work raises questions that you should try to avoid.

Quitting her job before filing for AOS would put her out of status, and subject to deportation if caught. But quitting after receiving the AOS application receipt is perfectly fine.

I endorse Jackolantern views. Living together/separately after marriage is not material to USCIS provided you convience them it is a genuine marriage.

You need to make sure that your spouse is not of status till you have the approved AOS
