USC and GC question

I got my GC on June 17th, 2002. I went to India for 56 days in 2005. So when can I start the process for Citizenship. Should I wait until March 2007(5 yrs-90)? Or should I wait longer?

My next question: My hubby is still on H1(since his company stopped processing for GC during downturn). We have been married for an year now. So when I get my citizenship, can I process his GC immideatly or does he have to wait for 3 yrs of our marriage to complete?

You can apply 90 days before your 5 years are complete as a USPR (from June 17, 2002). I would be safe and apply 80-85 days before instead of 90 days. Once you become a USC, your husband can apply for a GC without any wait time (as a visa number is always available for spouse or parents of a USC). For more information, refer to http://uscis.gov/graphics/howdoi/spouselive.htm

Note that your husband needs to maintain a legal status in the USA until then.

Good luck.

* You can apply after 17th March 2007.
* The 3 year of marriage rule applies when he is filing for citizenship and not for GC. You can file for his GC rightaway after you become citizen. When it is his turn to apply for citizenship you would already be married for 5+ years and therefore will not be an issue.

Thanks to all who replied. One more question.
My husband's H-1 might expire sometime next year(2007). His company is just starting the GC process thro PERM process. While that is going on parallely, what are our options, so that he doesn't have to go to India after his visa expires? Should I start his GC based on my GC? If I do that, once I get my citizenship, can I escalate his already existing GC application, so that he gets his GC immideatly? Can he have 2 GC applications (one thro company and one thro me)?

Try to have just one application - read all the posts on this site where people have two A numbers and the hassels they are facing at cittizenship time.
