US L1A Visa Holder & Canadian Citizenship Application pending- Need help

USL1Visa1

Hello All,

I have a valid US L1A Visa on my Indian Passport and my Canadian Citizenship Application is pending. I am yet to travel to the US on the L1A Visa.
I would like to travel to the US on my L1A Work Visa for Work Assignment before my Citizenship oath. I will travel back to Canada for oath & the new Canadian Passport- expected early next year. I have below queries-
1) When re-entering the US with my New Canadian Passport and with my active L1A Visa on my old Indian Passport, what steps I need to take at the port of entry? Will there be any issue that I may not be aware since I ll be switching my passport from Indian to Canadian Passport and my L1A Stamping will be on my old passport?
2) And what additional documentation I need to carry at the port of entry to US other than - the new Candian passport, my old Indian Passport that has the valid L1A visa, approved i129S & i797? Any modification to the petition documents is needed or not?
3) Also, will this have any impact on the L2 dependent visa (linked to my L1A Visa) for my wife who will continue to hold Indian Passport?

Regards,

A visa in an old passport is only valid if the new passport is of the same nationality.

“If your visa is still valid you can travel to the United States with your two passports, as long as the visa is valid, not damaged, and is the appropriate type of visa required for your principal purpose of travel. (Example: tourist visa, when your principal purpose of travel is tourism). Both passports (the valid and the expired one with the visa) should be from the same country. ”

@SusieQQQ Thanks for your response.
So, since, Canadian Citizens do not need to book a Consulate Appointment for L1A Stamping, this will be a new L1A stamping at the US, Port of entry on the Canadian Passport not a transfer of the Visa from the old Indian Passport to the new Canadian Passport?
Is this understanding correct?

Regards,

@SusieQQQ In this case, does this mean that the partition documents for L1A- Approved i129S and i797 needs to be modified before going to the US port of entry or the previous documents can be re-used?
And what will be the status of the L2 Visa linked to the L1A?

That’s beyond my pay grade, will wait for someone more specifically versed on intricacies of L1A to respond,

Once you get your Canadian passport, you need to present your I-94 (that you received when you initially entered US on L1, as an Indian citizen) AND your Canadian passport. This is to enter the US on your exiting L1A status (not the L1A visa anymore - since your Indian passport will no longer be valid for travel). Carry your original petitions/proof/documents that were used for obtaining L1A - if asked.

Your wife's L2 status is tied to your L1 status - not your citizenship.
