There is a wife and a husband, both born Canadian Citizens. She is currently seeking "a Physical Therapy position. If she moves to the states on her own gets a job on a TN visa and after 6 months of working her employer would like to apply for the Green Card for her. What happens to the spouse? Will he be able to move to the states with her and work? He is unable to to obtain any visa on his own and doesnt have a "degree".

thanks.

If the spouse's name is on the GC application when filed through an employer, the spouse automatically gets the green card. You can get a better response if you look in the Green Card by employment section of this forum. This forum is for family based green card.

Thanks

The husband can get TD status, if the wife gets a TN. The TD will not allow him to work though. If he moves to the US by the time she files for her I-485, then he can also apply for an EAD at the same time that she does. The EAD will allow him to work in the US. Keep in mind that the time between starting the PERM and filing the I-485/EAD/AP could be a couple of years.
