Hi

N-400 applied in Mar 2018 for Myself, Wife and Daughter - SFO office
Finger printing done on month
Interview call schedule in Apr 2019
Appeared for interview process all three
Officer went through whole process, and pass the interview.

At the end of interview officer told me that your application is denied because you applied exactly 3 days earlier than 90 days. She also mentioned that your whole family application is flagged for the same reason and will be denied. We all still had to competed the interview process, fully complete, passed and at the end denied for the same reason. Officer said you have to start the whole process all over again. Did lots of request to consider, but she said she can't do anything but deny the application.

I applied to USCIS online process and solely dependent on web site to allow me to submit if I am eligible and did not pay attention to count exact 90 days.
I really appreciate any feedback advice and if anyone was denied for this reason.

Yeah I have a friend who was denied for similar reason. He had to restart the process again and pay new fee but e everything went fast with the new application. So it's not applicable only to u

Thanks for your reply. When you say it was fast with new application if you remember how many months? Was it at SFO? because SFO is going real slow.

Isn't it their website glitch which allow us to submit the application even if it is not eligible?
Shouldn't they deny the application in the beginning rather than after one yer and completion of interview process?

I think you (or whoever submitted the application) need to take responsibility for this rather unfortunate situation and not try and blame it on “their website glitch” since I’m guessing you didn’t even use the online calculator to figure out when you’re eligible to file. I’m not quite sure about the online application system’s ability to determine early filing eligibility.

Unfortunately, the application isn’t reviewed for eligibility while it’s waiting in the queue, so it couldn’t have been denied until it was your turn to be interviewed.

I know of one person on another forum who successfully appealed but the case was not quite the same. In this case the person submitted on the correct date but the online system date stamped it the day before (I do not recall how that happened, maybe time zone). 3 days before sounds too much. If you want I can pm you the details of this person /the discussion on the other forum.

I’m not sure how it happened with you because I submitted online and it clearly stated the 90 days date but also would not allow submission before the 90 days date. However I did submit about 6 months after you. As mom says even with a website glitch it’s your responsibility to determine the date. The person I mentioned above was successful because he could clearly show he actually submitted on the correct date.

Mom correctly pointed out any denial on this basis can only be at interview. That is when the application is checked for completeness, errors etc as well as the actual details under which you apply. Can you imagine how long it would take if they had to check every application at the beginning as well as the end of the process?

Thanks guys much appreciated your feedback. I agree I could have gone through calculator. But I only found about calculator, after this denial happened to me. I also remember when I tried to submit one day earlier, it didn't allow me to submit saying you are not eligible yet and I solely trusted online process. Hi Susie can you pm me the details of the person/discussion, I would like to know more about his issue.

Yeah I briefly followed the discussion on the other forum that you mention. He/she did get a notification that they submitted on time, maybe it ended up being a time zone glitch. Anyhoos, it was a mere hours distinction. I don't think PMing that person's info to the OP would make any difference as OP here was 3 days early. There is a reason the online calculator exists. OP here admits to filing rather significantly early, and needs to take responsibility for that. No other option but to restart the process.
