Hello Friends,

My wife and I received our green cards on November 3rd 2004 and since then both of us have resided in the US continuously till date except for short trips to India once every year for a month. My wife and I will be eligible to file for our citizenship in August 2009. My wife along with kids (US citizens by birth) plan to move to India in April 20th 2009 to take care of her mother who is seriously ill. Below are our current plans, experts PLEASE advise if our plans do not jeopardize our eligibility for citizenship anyway.

- Wife will leave to India on April 20th 2009
- Wife will retrun back to the US on August 20th 2009 to file for the US citizenship
- Wife will return back to India after a week or two after filing for the
citizenship
- Wife will be back again sometime in September for finger printing and will
return to India after that
- Wife will be back to the US for citizenship interview
- Wife will make another trip to the to the US for Oath
- I will continue to work here in the US, pay taxes and reside until all of the formalities are complete pertaining to US citizenship. Because of my mother-inlaws health we dont have any other options execept to risk our citizenship. I would like to know if both of us will be risking our citizenship or will it be only risk my wifes citizenship?

Thanks in advance!

Suraj

I don't see any issues since you are staying in US and will remain in US while your wife travels to India to take are of her ailing mother. This is strong evidence to overcome any suggestion of break in continuous residence on your wife's side.
