US Citizenship Application Question

Hello Readers,

My friend has a question regarding the form N-400 form that he's in the process of filling up. The question is that he got married in India in 2004. He had a Green card at that time. His wife is an International Student in US now. In the N-400, there's a section that asks for the marital status and he's confused as to what he should write in that section because technically he didn't marry in the US and doesn't have a marriage certificate or anything of that nature in US. Although, he filed the past two years taxes in the US as "Married filing jointly".

He wanted to select the option of "Single" in N-400, and later on when he sponsors his wife for the Green card, then he will be obtaining his marriage certificate in the US in the current date and then file for her sponsorship. Is that a good idea? Please let me know what you folks think?

I have an indirect answer to you through another question:

If a family, husband and wife are immigrating to US, are they considered married by the USCIS or not, since they didn't marry in the U.S. and they don't have a marriage certificate in U.S.?

Moreover, he plans to select "Single"...what if the IO puts two and two together and sees that he filed income tax as "Married filing jointly"

so whats wrong in the case...your friend is married and his wife did not enter america through his green card...but one thing definitely to note is if whether his wife while applying for the student visa applied as single or married....if she applied single then there could be a lil problem....
also how can u file for taxes as married and apply for n400 as single what if they ask your friend for proof for tax returns....
think well before u apply,take ur time coz once u apply in haste its all over...now,this looks a bit complicated...best thing to do is hire a lawyer...

He has to be consistent ... 'married'. There is no question that legal marriages from other countries are recognized in the US. Imagine the mess if it would not be like that !!

you are right suzy,i dont think in india there is any hard rule that u have to register your marriage as soon as u get married,even if there is tht rule not many register...forget uscis even indian officials wouldnt know for sure if an individual is married for sure...

and that is grounds for denial of your citizenship application :eek:
