US Citizen - Sponsoring Children and Staying Out Of USA

Hey Guys,

My US Citizen uncle is in a dilemma and we are looking for input from other folks who might know about it.

He has filed for his children in 2011 (Family Based Immigration which might take a long time before their files become current). He wants to live in India and not stay in USA if not needed for the Sponsorship of his children.

Is there a period of time he needs to stay in the USA being a US Citizen? I know with green card you cannot stay more than 6 months in the 5 years time frame for US Citizenship.

Any USC can file an I-130 for relatives (unless barred for prior fraud). The USC must be domiciled inside the U.S, for I-864 purposes however, exceptions exist. Exceptions include employed abroad by the U.S. government (see the I-864 form instructions), or when the alien relative qualifies to file an I-864W. Last and least desirable is the use of a substitute sponsor in the event of death of the I-130 petitioner.

The I-130 has been filed in 2011. When is the domicile needed? I think it might take 10 more years for the file to be current. Does he need to stay in the US during this 10 years or can come to US later on (a year or so in advance) and establish his domicile?

See the I-864 instructions. Domicile is in connection with the I-864 filing.
