I am a US citizen and my husband is a canadian citizen. Currently we reside in canada. I am a temporary resident with a work permit through the NAFTA agreement. I have already submitted everything for permanent residency in canada and should receive it soon. We think we will move back to the US in a year or two. He went to university in the US for 4 years then lived and worked in the US for 1 year on an extension of his student visa. Can we start the application for a green card for him now? Does it matter that I do not live in the US?

You may have to show domicile in the US. Or at least the intention to move to the US real soon.
