US Citizen Filing for Spouse in Houston

I am about to get my US Citizenship. My husband is on H1(b) and I would like to file his GC as soon as I get my citizenship.

I have the following questions:

1. When exactly can I file for his GC ?. Is it just after my OATH or after getting my US PASSPORT ?.

2. What are the forms I need to file( I130, I485...)

3.Has anyone filed for there Spouse with out a lawyer ?. I am trying to see whether I need to hire a lawyer . My husband entered this country as Student.

After you get your naturalization certificate.

Most of us here filed without a lawyer. Do your own research and read as much as you can. The forms are easy to fill. This forum is abundant with useful information and you will find all answers if you look around.

I am in a similar situation, I came to the US as a student and my husband is a citizen (by birth though, not naturalized) and we filed everything without a lawyer. We read the instructions for each file, made copies of various documents and filed them. My process is recent but has been going smoothly.
I remember reading that there are several ways to prove the relatives citizenship and I am sure that the naturalization papers will be as good as a US passport!
Good luck on your process, learn by doing it yourself and save money by not having to hire a lawyer :)

DO you mean I need to file N600 and get the certificate to file for my husband ?. OR Are you refering the certificate the one we get in the OATH ceremony.?
 
N-600 is for an individual to document U.S. citizenship status based on citizen parentage.

You will receive a naturalization certificate after your oath and that is proof of you being a USC.

Make sure you have the right number of G-325A sets that go with the I-130 and I-485. (total should be 3 for the whole AOS package). Other than that, everything looks okay. There are cover letters attached to the first post of the AOS Interview Timeline thread. If you havent already seen them, i suggest you take a look and include them with your app to make your package look more organized ;). Follow the assembling instructions as mentioned on the USCIS site. Good Luck! :)
 
I have started filling the application though I can file only in June. I have following questions:

1. I am filing based on USC filing for Spouse who is on H1B visa. In 485 application, Part 2( I am applying for adjustment status to Permanent Resident Status becasue) , should I check the type a ?

2. In Part3 Processing information: Were u inspected by a us immigration officer ? does this question refers to the immigration office stamps the passport in the border or something else ?.

3. 484 Should include following doc right ?. Am I missing anything ?

Mesquite, TX 75185-0919 with the appropriate POBOX based on the form like I130 or I 485..and not chicago lockbox facility.correct ?

Typically your husband fills the I-485, but yes... option (a) is what you need if you are filing I-130/I-485 concurrently or if you have an approved I-130 with a current PD.

Yes. Thats correct. If your husband had to go through the POE upon entry to US, you would check 'Yes' on your application. A 'No' means entering the US illegally and the I-485 will be denied unless you file for a waiver claiming extreme hardship

Yes, you need to fill out all four pages. If you look closely, the footer is different for each page. There is a reason why there are four copies as each are sent to different offices for your name check. One copy will be sent to the US consulate of your husband's country of birth for verification

WRONG. You should mail all forms to the chicago lock box as the NBC currently proceses all family based GC applications

In the current I130 form it says " if u live in Alabama,Arkansas,Georgia, ......Tennesse,texas etc mail this petition to USINS Texas service,.. Mesquite, TX.

Is this correct ?

Also in the link u provided it says to submit I485,EAD,AP to chicago lock facility but it didn;t mention about I130.

I am confused. Please Clarify.

NBC takes care of family based applications and the instructions in the forms are sometimes outdated and take a while to be updated.

thanks ari4u. One more question: May I submit all these form separated by stapler it in one envelope or mail I130 separately then I485 separate ?

Also for filing EAD & AP do I need to wait untill I get the A# number for the filed I130 & 485 ?

Dont use stapler, use ACCO fasteners instead. Package assembling instructions...

You are eligible to file for EAD and AP along with your I-485. You dont necessarily have to wait till you get the A#

No. You have to send all applications in one package. Separate each application with a cover letter and print on the cover letter as to the type of form. If you look at the link i provided earlier, it has samples of cover letters you can improvise to suit your need.

7. If you are sending more than one case in an envelope, clearly separate the cases by rubber band or clip fasteners.
