Hi all,

Recently I got my citizenship process done, will be getting
my US passport in a couple of weeks.

I would like to know what the process is to apply for my
wife's green card. She is on H-1 right now.

We got married in 2004 when I was on GC and I waited
till I become citizen to apply for her GC.

If I apply for her GC now as a US citizen, how long does
it take for her to get GC.

Thank you very much for your help.

Regards
Sun

My husband (will be USC soon) and I are doing the same thing without lawyer. (Well I am doing 99%!) What I did was to go to immigration site (www.uscis.gov) and download the PDF forms that are needed.
You can start with I-130, I-485, I693, I751, I765, I864, I864p, I-131, g325a. Read the instructions on all the pdfs more than once. They are confusing but most info you need is on them.

You can then come back here or go to other greencard help websites/forums and read up on old threads or post specific questions.

If not, I suggest hiring a lawyer.

good luck.

Jasmine7103 is right, all the forms are out there, I did it myself too. Honestly you don't even need a lawyer unless there's a specific reason that might impact her GC approval.

fammic,

not that it matters anymore now you got GC.... that's horrible that you never received the actual EAD card?! So you weren't able to work till you got your ead card? looks like everything else went very smoothly! cograts. :)

Hi,

Is it a must to file I-765 (EAD) with the 485, 130 and other
applications ?

or

Can she work on her existing H-1 till her GC gets approved ?

Thanks
Sun

nope...

...765 (work permit) and 131 (advance parole) are both optional. Since, in your case, the spouse has an H1 status...EAD is not required unless he/she is changing jobs or is going to get laid off (hopefully not) OR if the spouse wants to start working part-time somewhere else besides the current job.
H1 stays valid even after applying for AOS (after filing 485) since it's dual intent.
Save the $180 (or 170)...for your shopping :-)
