Nothing illegal in getting Indian citizenship

I think that this is a case when 2 policies in 2 different countries do not match.
I believe that the Indian Passport is perfectly legal and can be used to travel to any other country, except USA. For arguments sake, there is nothing stopping gcwanted_new to apply for a visa to travel to a third country using his son's indian passport. I am sure that the consulate would be confused seeing place of birth as USA on an Indian passport for a small kid ( < 18yrs old ). But, according to Indian law it is legal for the kid to take Indian citizenship. In fact, if gcwanted_new wanted to stay in India, he may have wanted just that. For all we know, gcwanted_new son may have billions in inheritance that he might lose if he does not have Indian citizenship.
However, from USA's point of view, he cannot use that passport to enter USA. He will be considered a US citizen here. According to INA 349, a minor cannot, voluntarily or involuntarily lose US citizenship.
