Urgent!!

Hi all,

As you all must be knowing I have not yet received the RFE dated 08/Aug/03 for my 485 case. The 12 week period that I have to respond to the RFE will expire on 31/Oct/03. So far I have called the 800 customer service number at least 8 times in the last 8 weeks. I have sent TSC 2 letters (1 to the attention of the director). My attorney has sent them 2 letters. I have approached my local senator. So far, nothing that I do seems to succeed in bringing this matter to the attention of TSC.
With direct access to the service centers being cut off both for applicants and their attorneys this is the worst thing that can happen because the customer service center people seem pretty useless. On one of the calls my wife was transferred to an immigration officer who bluntly told her that there was nothing he could do to get TSC to re-mail the RFE!!! So, what are we supposed to do. They are hanging us out to dry here.
I would appreciate any suggestions different from the above attempts already made. Anybody with any advice.

TSC is bullshit. Now that thing has happened, you better keep all records that you try to contact TSC. You will recieve a deny letter sooner or later. Supposed it is not your fault (for example, you didn't notice TSC or BICS that you had moved to new house), you and your attorney can go to immigration court to appeal with your evidence and records. TSC is supposed to resend another RFE if you haven't received it after *** days ( don't remember exact days).

As a last resort, you can contact the FEDERAL legislator/senator whoever you feel comfortable with. It is better that you go to one of their local offices in person (as far as I know, they have local offices usually in several major cities of a state. I am sure you can find the info on internet). Immigration is a federal law, so state legislator/senator may not work or care.

If you call before you go, and they let you go there, you should bring all the things you have done up to today and show them that you have no other ways to get in touch with BCIS and your application is in danger. If you have an American born kid, bring him/her with you.

If there is no local office in your city, go to the nearest one. Remember to call before you go.
