URGENT------Visa/I-94 valid for 10 more days. Can I re-enter USA?

Hi,

I am visiting India till September 10th.
My H1B I-94 and Visa will expire on September 24th.

My company filed for my extension on July 14th and obviously it is not approved yet.

I have the below questions/concerns:

1.
Is it safe to go to India and come back on my old I-94 and Visa. Or will I have problems as they are valid for long?

2.
Also incase my petition gets approved while I am in India, is it compulsory for me to attend visa on my new I-797 in India? Or can I come back and go to Mexico or Canada?

3.Worst case should I be requesting my attorney to file premium processing (I have to pay the $ 1000)

Please advise.
I will be travelling in a week.

Not sure coming before 14 days is an issue. If your new H-1 is approved, make sure that you use your new h1-b for re-entry.

But can I use my new H1-B for reentry though my visa is related to my old I-94? (same employer though)
